Legal Fallout from the Dieselgate Emissions Scandal
On Friday 28 July, there will be a half-day on the legal fallout from the VW “Dieselgate” emissions scandal, with New York Times author Jack Ewing who has just published a book on the subject, plus lawyers acting for VW investors, VW vehicle owners and Greenpeace.
AGENDA
9:00 am FASTER, HIGHER, FARTHER: WHEN CORPORATE COMPLIANCE MECHANISMS FAIL
Jack Ewing, European Economics Correspondent, The International New York Times, Frankfurt
How did one of the world’s most respected companies end up at the centre of a global scandal which rocked the car industry and damaged consumer confidence? New York Times journalist Jack Ewing will talk about how the emissions scandal unfolded and the corporate failings within Volkswagen which led to this unprecedented saga, documented in his new book „Faster, Higher, Farther: The Volkswagen Scandal“. He will tease out the lessons that can be learned in corporate governance, risk management and compliance.
All participants in this session will receive a complimentary copy of „Faster, Higher, Farther: The Volkswagen Scandal“, and Jack will be available to sign your copy during the morning.
9:50 am CONSUMER REDRESS: MY CAR’S WORTH LESS NOW
Evan O’Dwyer, Irish Solicitor and Litigation Specialist, O’Dwyer Solicitors, County Mayo
What avenues of redress do owners of VW Group brand diesel cars have in the wake of Dieselgate? Evan O’Dwyer will talk about his representation of a County Mayo nurse, Eithne Higgins, the owner of a Seat Leon, who came to him with exactly that question. Evan is now acting for several hundred aggrieved Irish motorists in a class action lawsuit.
10:40 am Coffee Break
11:10 am EMISSIONS STANDARDS AND ENVIRONMENTAL REGULATION IN THE WAKE OF DIESELGATE
Dr Benjamin Stephan, Mobility & Climate Change Campaigner, Greenpeace, Hamburg
What are the existing laws and standards on diesel emissions in Europe and elsewhere? Are they sufficient, and are they adequately enforced in various countries? How did Volkswagen manage to circumvent them for so long? Dr Benjamin Stephan will talk about Greenpeace’s campaigning following the Dieselgate revelations and its efforts to try to achieve better air quality in German cities.
12:00 noon SHAREHOLDER RETRIBUTION: CLASS ACTIONS BY VW INVESTORS
Dr Nadine Herrmann, Partner, Quinn Emanuel, Hamburg
Volkswagen’s largest investors are a significant constituency and a number of them are alleging that as shareholders in the global car giant, they suffered loss as a result of the Dieselgate emissions scandal. Dr Nadine Herrmann will explain the intricacies of the case seeking damages presently before Germany’s Braunschweig District Court, in which shareholders are alleging in part that VW failed to publish market sensitive information in a timely manner, in breach of German securities law.
12:50 pm Lunch and Close
NOTE: Knowledge Nomads has extended an invitation to Volkswagen to send a speaker to participate in this session.
